Via Consular? or Adjustment of Status? 

This article comes to answer the main elements and the differences between doing the process of legal residence of the United States via Consular or via Adjustment of status. 

The legal residence or green card is the authorization given by the United States government to foreigners to live and work in the United States indefinitely, as long as, they obey the laws of this country.

Generally, the legal residence process can be done Consular or through Adjustment of Status. All processing is done at and through the US Department of Immigration and the US Department of State which regulates consulates.

Both processes lead to legal residency in the United States. 

The biggest difference between the consular process and the adjustment of status procedure is:

 a. The consular process, as its name indicates, is completed through the American consulate of the country where the foreigner is located. The legal residence appointment is at the American Consulate. 

b. The adjustment of status process, the foreigner is in the United States, and the green card appointment is made at the corresponding immigration office.

Important, not all foreigners qualify for adjust status even if they are in the United States. Similarly, not every foreigner qualifies to obtain a green card to live and work in the United States. 

You should meet with a professional attorney knowledgeable in United States immigration matters before beginning your green card process.

Via Consular? o Ajuste de Estatus?

Este articulo viene a responder los elementos principales y la diferencia entre hacer el proceso de residencia legal de los Estados Unidos vía Consular o vía Ajuste de estatus. 

La residencia legal o green card es la autorización que da el gobierno de los Estados Unidos a extranjeros para vivir y trabajar en los Estados Unidos de manera indefinida, siempre  que se  obedezcan las leyes de este país. 

Generalmente el proceso de residencia legal se puede hacer de manera consular o a través de ajuste de estatus. Todo el procesamiento se hace en y a través del Departamento de Inmigración de Estados Unidos y el Departamento de Estado de Los Estados Unidos que es quien regula los consulados. Ambos procesos llevan a la residencia legal en los Estados Unidos.

La diferencia más grande entre el procedimiento consular y el procedimiento de ajuste de estatus es: 

a.El procedimiento consular, como su nombre lo indica, se completa a través de consulado americano del país donde se encuentra el extranjero. La cita de residencia legal es en Consulado Americano.  

b.El procedimiento de ajuste de estatus, el extranjero se encuentra en los Estados Unidos, y la cita de residencia se hace ante la oficina de inmigración correspondiente. 

Importante, no todo el extranjero califica para hacer ajuste de estatus, aunque se encuentren en los Estados Unidos. De igual forma no todo extranjero califica para la residencia legal de los Estados Unidos. 

Usted debe reunirse con un profesional abogado conocedor de la materia de inmigración de los Estados Unidos antes de empezar su proceso de residencia legal. 

Para la mayoría de los extranjeros el tener la residencia legal en los Estados Unidos representa un gran adelanto de estabilidad familiar y financiera.
